2006 Mini Cooper loosing coolant

My car was hit last year and when it went for it's MOT this year there was no coolant in the bottle. Mini told me to keep an eye on the coolant level and to ring them straight away if the level dropped as it was about to run out of its warranty. Anyway the level never dropped but hep presto when it's out of its warranty the level has dropped. This was noted on the MOT report.
As it is out of warranty and because this problem was found are Mini oblidged to fix it free of charge!!!

should be done under good will aslong as you are the 1st registered keeper
