Transmission doesn't disengage in snow

I repeatedly have difficulty in snow because the transmission will not stay in neutral when it has been shifted into neutral OR when the clutch is fully depressed; the minute I put my foot on the brake the gears grind and I can't stop or shift back into neutral.

2009 car ? Take it back to dealer under warranty .
