2010 Citroen Berlingo head gasket

bought above four months ago with only 38,000
miles on clock now only 40,000. difficult to start then engine sounded like misfiring. Just about got it to garage they said Head gasket has gone, Dealer refusing to accept problem as 3 month warranty expired.but only done 2,000 miles. Does anyone know what sort of mileage would warrant such major problem has anyone else had this problem with Berlingo first hdi

Unusual for a head gasket to go at that mileage on any car unless caused by another fault on cooling system etc .Did the car come with verified mileage and any service history ?

Yes the dealer said all cars are hpi checked did not do this ourselves based on this. Record of two services plus service on purchase

If bought from a Citroen dealership , been serviced by them as per manufacturers schedule and due to the low mileage on purchase / since , ask them to see if Citroen will a least make a contribution to repair .If not , will they ? Shouldn't normally happen at that mileage , always best to get a copy of the hpi check along with a mileage verication certfificate from dealer .

l purchased not direct from Citroen but garage that sells mainly there vans. l have now done a hpi check all in order and mileage
on past two MOT correct. Under Sale of Goods Act 1979 does anyone know
if l can claim repair or exchange due to fault within 6 months of purchase. As due to low mileage car must have had fault somewhere
on purchase
